General Terms and Conditions (AGB)

swim4u.ch – Swimming school for adults

1. scope of application

These General Terms and Conditions (GTC) govern the contractual relationship between swim4u.ch (hereinafter “swim4u”) and its customers (hereinafter “Participants”) for all services offered, in particular

  • Group courses

  • Private lessons (individual or small group lessons)

  • Open Water Trainings

By registering, participants accept these GTC as binding.

2. offer and conclusion of contract

You can register for an offer from swim4u via:

  • Online registration form at www.swim4u.ch

  • e-mail

  • WhatsApp

  • By telephone

  • Verbally (e.g. on site)

All forms of registration are legally equivalent and binding.

Upon receipt of the registration, the participant submits a binding offer to conclude a contract.

Course places are allocated in the order in which registrations are received (“first come, first served”). A claim to a course place only exists with express confirmation from swim4u.

Confirmation and access

For group courses, the contract confirmation is always sent by email.
For private lessons, confirmation can be sent by email, WhatsApp, telephone or verbally.

The contract is concluded when swim4u sends the confirmation.

The participant is obliged to provide a correct and functional e-mail address and to check the spam folder regularly.

A confirmation email is deemed to have been delivered as soon as it has been sent by swim4u to the email address provided.
The risk of non-delivery due to technical problems, spam filters or incorrect address details is borne by the participant.

If no confirmation is received within 48 hours of registration, it is the responsibility of the participant to contact swim4u.

The content of the contract is determined by the confirmed course details and the prices and GTC valid at the time of registration.

3. services

The exact scope of services can be found in the respective course description on www.swim4u.ch.

There is no entitlement to a specific course leader. swim4u reserves the right to replace course leaders with equally qualified persons if necessary.

4 Prices and terms of payment

4.1 Prices

The prices published at the time of registration apply.
All prices are in Swiss francs (CHF).

4.2 Group courses

The entire course fee is due before the start of the course.

Payment is made by e-banking in accordance with the invoice details. Cash payment is possible by prior arrangement.

Without timely payment, there is no entitlement to participation. swim4u is entitled to pass on the course place in the event of non-payment.

4.3 Private lessons

Private lessons are to be paid before or at the latest on the first appointment, according to the invoice.
For package bookings, the total amount is due in advance.

5 Withdrawal and cancellation

5.1 Group courses

Cancellations must be made in writing by e-mail.

  • Withdrawal ≥ 14 days before the start of the course: free of charge

  • Cancellation 14-7 days before the start of the course: 50 % of the course fee

  • Cancellation < 7 days before the start of the course: 100 % of the course fee

  • No-show: 100 % of the course fee

Upon presentation of a medical certificate covering the entire duration of the course, 50% of the course fee will be refunded.

5.2 Private lessons

Appointments must be canceled by telephone (079 823 17 14). If you cannot be reached, a message via WhatsApp is permitted.

  • Cancellation less than 24 hours before the appointment: 50% of the lesson

  • No-show without deregistration: 50 % of the lesson

6. absences

Missed lessons can neither be made up nor refunded.
There is no entitlement to substitute lessons.

7. course cancellation or change by swim4u

swim4u reserves the right:

  • Cancel or combine courses if there are insufficient participants (minimum number of 6 persons)

  • Adjust course times or course locations

  • Cancel open water training courses at short notice in the event of unsuitable weather, water or safety conditions

If a course is canceled by swim4u, the course fee will be refunded in full.

If an ongoing course has to be canceled for important reasons (e.g. force majeure, official order), a pro rata refund will be made.

Further claims are excluded.

8. admission costs

Admission to indoor or outdoor swimming pools is not included in the course fee, unless expressly communicated otherwise.

9. health requirements

Participation is at your own risk.

Relevant health restrictions (e.g. cardiovascular diseases, asthma, diabetes, orthopaedic complaints, operations, etc.) must be reported to the course management before the start of the course without being asked.

10. special regulations for Open Water Trainings

Open water training takes place in natural waters and is associated with increased risks (e.g. currents, water temperature, limited visibility, boat traffic).

Participants confirm:

  • that they can swim safely

  • that they are aware of the particular risks

  • that they must follow the safety instructions

Participation is at your own risk.

swim4u reserves the right to cancel or interrupt training sessions at any time for safety reasons.

11 Insurance and liability

Participants are responsible for taking out adequate accident and liability insurance.

swim4u is only liable for damages caused by intentional or grossly negligent behavior.

Liability for slight negligence and for indirect or consequential damages is excluded to the extent permitted by law.

No liability is accepted for the loss or theft of personal items.

12. data protection

Personal data is used exclusively for contract processing and course organization.

Processing is carried out in accordance with Swiss data protection law.

13. changes to the GTC

swim4u reserves the right to amend these GTC at any time.

For existing contracts, the version valid at the time of registration applies.

14 Applicable law and place of jurisdiction

Swiss law applies exclusively.

The place of jurisdiction is Zurich, insofar as there are no mandatory legal provisions to the contrary.
