Welcome to swim4u.ch
Our goal is to provide all participants with safe, professional, and enjoyable swimming lessons.
The following General Terms and Conditions (GTC) establish a clear framework for our collaboration and help ensure that our courses run smoothly.
By registering for a swim4u program, participants agree to the following Terms and Conditions.

1. scope of application
These General Terms and Conditions (GTC) govern the contractual relationship between swim4u (hereinafter “swim4u”) and the participants in all services offered.
They apply in particular to:
- Group Swimming Classes
- Private lessons
- Open Water Trainings
- Workshops
- Specialized Training Sessions
- Other services offered by swim4u.
By registering, you agree that these Terms and Conditions are a binding part of the contract.
Any deviating agreements must be in writing.
2. offer and conclusion of contract
You can register for an offer from swim4u via:
- the online registration form at www.swim4u.ch
- Phone
- in person on site
All forms of registration are legally equivalent and binding.
Upon receipt of the registration, the participant submits a binding offer to conclude a contract.
Course spots are generally assigned on a first-come, first-served basis.
A spot in a class is not guaranteed until swim4u has expressly confirmed it.
Confirmation of Registration
For group courses, registration confirmation is always sent by email.
For private lessons, confirmation can be provided:
- by email
- via WhatsApp
- by phone
- orally
The contract becomes binding upon confirmation by swim4u.
Delivery of the Confirmation
The participant agrees to provide a valid and working email address when registering.
She is required to check her spam or junk mail folder regularly.
A confirmation sent by swim4u to the specified email address is considered delivered.
Technical problems on the recipient’s end, spam filters, or an incorrect email address do not relieve the recipient of their contractual obligations.
If no confirmation is received within 48 hours of registration, the participant agrees to contact swim4u immediately.
Communication
Communication between swim4u and the participants takes place via email, phone, or WhatsApp, depending on the situation.
By registering, the participant agrees that organizational information, scheduling arrangements, and other communications may be sent via these communication channels.
3. Course Seats and Implementation
The number of spots in the course is limited.
Places will be assigned on a first-come, first-served basis.
swim4u can maintain waiting lists.
There is no guarantee of admission to a fully booked course.
There is also no entitlement to a specific instructor.
swim4u reserves the right to adjust course instructors, class locations, or class times for organizational or operational reasons, provided that this does not significantly alter the overall nature of the program.
Course instructors are authorized to issue organizational or safety-related instructions. Participants must follow the course instructors’ instructions at all times.
4. Services
The scope of services is based on the respective course description at www.swim4u.ch.
In particular, the following are not included in the services:
- Swimming Admission Tickets
- personal gear
- Insurance
- Getting to the Course Location
swim4u is committed to conducting all courses with qualified instructors to the best of its knowledge and belief.
However, a specific level of learning success cannot be guaranteed.
5. Prices and Payment Terms
Only the prices published on www.swim4u.ch at the time of registration apply.
All prices are in Swiss francs (CHF).
Group courses
The full course fee must be paid in full before the course begins.
Payment is generally made by bank transfer upon receipt of the invoice.
Cash payments are accepted by prior arrangement.
If payment is made at short notice, swim4u may request proof of payment.
If payment is not received by the due date, you are not entitled to participate.
swim4u reserves the right to assign unpaid course spots to other participants.
Private lessons
Private lessons or private lesson packages must be paid in full as indicated on the invoice, either before or no later than the first session.
Late Payment
If a participant defaults on payment, swim4u is entitled to,
- Late fees,
- Collection costs,
- Collection costs, as well as
- Additional Costs of Debt Collection
to be billed.
Outstanding receivables may be transferred or assigned to a collection agency for further processing.
swim4u also reserves the right to suspend the provision of further services until all outstanding balances have been paid in full.
6. Withdrawal and Cancellation
Group courses
Cancellations must be submitted in writing via email to info@swim4u.ch .
The following cancellation policy applies:

| Less than 7 days before the course begins | 100% of the course fee |

Failure to pay the invoice does not constitute cancellation.
Private lessons
Appointments must be canceled by phone or via WhatsApp.
A cancellation is considered timely if it is received by swim4u at least 24 hours before the scheduled appointment.
If the cancellation is made less than 24 hours before the scheduled time, or if the participant fails to show up for the class without prior notice (no-show), 50% of the cost of the booked lesson will be charged.
Failure to attend a private lesson does not exempt you from the obligation to pay in accordance with these regulations.
7. Absences, Illness, and Accidents
Participants are responsible for ensuring their regular attendance at the course.
Missed lessons generally cannot be made up or refunded. This also applies specifically to:
- Illness
- Accident
- Vacation
- work-related conflict
- Military service, civil defense, or civilian service
- family obligations
- as well as for other personal reasons.
There is no entitlement to make-up lessons, private lessons, credit, or refunds.
Failure to attend individual lessons does not relieve you of the obligation to pay in full for the program you booked.
8. Course Changes, Course Cancellations, and Force Majeure
swim4u reserves the right to combine or cancel classes if there are not enough participants.
The minimum number of participants is generally six, unless otherwise specified in the course description.
The participants affected will be notified, if possible, no later than seven days before the course begins.
If swim4u cancels a class, any course fees already paid will be refunded in full.
If a course that has already begun must be terminated early for valid reasons, a pro-rata refund will be issued for the services not provided.
Force Majeure
If a course cannot be held, or can only be held in part, due to force majeure, swim4u is not liable for any resulting damages or consequential costs.
The following, in particular, are considered force majeure:
- official orders
- Natural phenomena
- Pandemics or epidemics
- technical malfunctions
- Short-term closures of indoor or outdoor swimming pools
- Closure or suspension of a training facility
- as well as other events beyond swim4u’s control.
In such cases, swim4u is entitled to,
- To reschedule classes,
- to adjust the course location,
- to offer equivalent make-up lessons,
- or to refund, on a pro-rata basis, course fees that have already been paid for services not rendered.
Further claims are excluded.
9. Admission Fees
Unless otherwise expressly stated in the respective course description, admission fees for indoor, outdoor, or lake swimming pools are not included in the course fee.
Participants are responsible for covering all admission fees themselves.
For classes held at school swimming facilities, the respective terms of use established by the operators apply.
The facility and pool rules of the respective swimming facilities must be followed and form an integral part of the terms and conditions of participation.
10. Health Requirements
By registering, the participant confirms that he or she is physically able to participate in the booked activity.
Participation in all activities is at your own risk.
Any health limitations or pre-existing medical conditions that could affect the safe conduct of the class must be disclosed to the course instructor before the course begins, without being asked.
This applies in particular to:
- Cardiovascular Diseases
- Asthma or other respiratory diseases
- Diabetes
- Epilepsy
- Diseases or injuries of the musculoskeletal system
- recent surgeries
- Pregnancy
- Allergies That May Affect Classroom Instruction
- other health conditions that could compromise your own safety or that of other participants.
Course instructors are authorized to exclude participants from individual lessons or the entire course for safety reasons if there are reasonable grounds to doubt that their safe participation can be guaranteed.
Such exclusion is intended solely to protect the person concerned and the other participants, and does not entitle the person to a refund of the course fee.
11. Open Water Training
Open-water training sessions take place in natural bodies of water and differ significantly from swimming in indoor or outdoor pools in terms of safety requirements.
Participation is entirely at your own risk.
Eligibility Requirements
The requirement for participating in an Open Water training session is:
- a safe swimming technique,
- good physical condition,
- the ability to swim at least 1,500 meters without stopping,
- as well as the prior signing of the separate consent and risk waiver form for Open Water training sessions.
Participation is not permitted without a signed risk waiver.
Security
The safety of all participants is our top priority at all times.
Participants agree to,
- to follow the course instructor’s instructions at all times,
- to swim exclusively within the specified training zone,
- not to leave the group without permission,
- to immediately notify the course instructor of any health issues or discomfort,
- and to act responsibly toward themselves and other participants.
Wearing a highly visible open-water safety buoy is mandatory throughout the entire training session.
Depending on water or weather conditions, the course instructors may also require participants to wear a wetsuit or other safety equipment.
Weather and Environmental Conditions
Open Water training sessions are conducted only when safety conditions permit.
In particular, a training session will not take place if:
- Thunderstorms,
- Strong winds,
- dangerous waves,
- Water temperatures below 16 °C,
- poor visibility,
- or other circumstances that could compromise safety.
The course instructors are solely responsible for assessing the safety situation.
The course instructors are authorized to postpone or cancel a training session at any time, or to exclude individual participants from the training for safety reasons.
In these cases, there is no entitlement to performance or a refund.
12. Exclusion of Participants
swim4u places great importance on providing a safe, respectful, and enjoyable learning environment.
swim4u therefore reserves the right to exclude participants from classes, in whole or in part, at any time, particularly if
- Safety instructions are repeatedly disregarded,
- the behavior significantly disrupts the class,
- endanger or harass other participants,
- property damage is caused intentionally,
- or if the course instructor’s instructions are repeatedly disregarded.
A suspension may be permanent or apply to individual lessons.
In these cases, there is no entitlement to a refund of the course fees.
13. Insurance and Liability
Participation in all swim4u programs is at your own risk.
Each participant is responsible for ensuring that they have adequate insurance coverage.
Accident insurance is required. Personal liability insurance is recommended.
swim4u is liable only for damages that can be proven to result from swim4u’s intentional or grossly negligent conduct.
To the extent permitted by law, any liability for
- slight negligence,
- indirect damages,
- Consequential damages,
- Financial losses,
- lost profits,
- Loss or Theft of Personal Belongings
excluded.
swim4u assumes no liability for clothing left in the locker room, vehicles, valuables, or personal equipment.
Use of the facilities at each swimming pool is at your own risk and must comply with the applicable house rules and swimming regulations of the respective operator.
14. Data Protection
swim4u processes personal data exclusively in accordance with applicable Swiss data protection laws.
Personal data is used exclusively for:
- the registration,
- course organization,
- communication with the participants,
- billing,
- as well as to comply with legal obligations.
Personal data will be disclosed only to the extent that
- this is necessary for the performance of the contract,
- there is a legal obligation to,
- or the data subject has given explicit consent.

15. Photography and Videography
Photographs or videos of participants will be taken or published only with their prior consent.
Consent may be revoked at any time, effective for the future.
The cancellation must be submitted in writing or by email to swim4u.
16. Changes to the General Terms and Conditions
swim4u reserves the right to amend these Terms and Conditions at any time.
The version in effect at the time of registration is the one that applies.
The latest version is available at www.swim4u.ch .
17. Severability Clause
Should any provision of these General Terms and Conditions be or become invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall remain unaffected.
In place of the invalid or unenforceable provision, a provision shall be deemed to have been agreed upon that comes as close as possible to the economic purpose of the original provision.
18. Governing Law and Jurisdiction
Swiss law applies exclusively.
The place of jurisdiction for all disputes arising out of or in connection with these General Terms and Conditions and the services offered by swim4u is Zurich, unless otherwise required by mandatory statutory provisions.
